Hampshire County, Massachusetts Arrest Records

Law enforcement agencies in Hampshire County perform a wide range of administrative functions to uphold law and order in the county. A primary example of this responsibility occurs after an arrest. In accordance with established practice, responding officers record essential details regarding the apprehended individual and the specific arrest circumstances into various official databases. Depending on the particular custodian, these files are maintained as standalone documents or integrated into broader criminal history information. Such records are ultimately retained by local agencies as formal Hampshire County arrest records.

Agencies with arrest authority in Hampshire County include municipal police departments, such as the Amherst, Northampton, and Easthampton Police Departments, among others. The Hampshire Sheriff's Office likewise has the legal authority to conduct arrests and oversees the county jail; however, its duties generally involve civil process within the county.

The dissemination of arrest records in Hampshire is primarily governed by M.G.L. c. 66, § 10 (the Massachusetts Public Records Law), alongside the provisions set forth in M.G.L. c. 6, §§ 167-178 (for criminal history data).

Are Arrest Records Public Information in Hampshire, Massachusetts?

Yes, Hampshire arrest records are available to the public. The Massachusetts Public Records Law governs access to arrest records. Consequently, any individual may obtain these records by providing sufficient details to a records custodian (usually law enforcement) to facilitate retrieval. A nominal fee may be required.

Records available to a requester depend on several factors, including whether the records contain sensitive information protected by privacy laws, whether the records have been sealed or expunged, and the identity of the requester. In certain cases, different individuals may access different levels of information, depending on the requirements they satisfy.

What Do Public Hampshire County Arrest Records Contain?

Public Hampshire County arrest records provide a concise overview of arrest incidents, including basic biographical data of individuals taken into custody (e.g., the suspect's full name and age), the specific initial charges, and the booking date and time. Furthermore, such records may include the arrestee's residential address and the precise location where the arrest occurred.

Active Warrant Search in Hampshire County

The administration and availability of arrest warrants within Hampshire County are primarily dictated by the provisions of M.G.L. c. 276, which regulates their issuance and subsequent execution.

An arrest warrant functions as a formal judicial decree empowering officers to take a specific individual into custody; such writs remain active and legally binding until they are successfully executed ("served"). Arrest warrants present the suspect's identity, the date of judicial authorization, and the underlying legal justification for the order. Moreover, they specify the alleged offense, required bail figures (if any), and the signature of the committing magistrate.

The primary custodians of warrant information in Hampshire County are judicial bodies and law enforcement departments, specifically those exercising jurisdiction over the region where the writ was authorized or served.

Although Hampshire County arrest warrants are classified as public under the Massachusetts Public Records Law, they may temporarily remain confidential for a set duration following issuance to avoid jeopardizing police investigations.

To obtain open warrants in Hampshire County, one may search case histories maintained by the issuing court. Searches through law enforcement are also possible, but these carry an inherent possibility of arrest where the inquirer is the same entity as the subject of the warrant.

In contrast, arrest records generally compile information relating to multiple arrests involving the same individual and provide a broader summary of the person's law enforcement interactions. How to Get an Arrest Record Expunged in Hampshire County

In accordance with Massachusetts law, an expungement provides for the permanent destruction of an arrest or other criminal history record. Any expunged record is purged and effectively ceases to exist.

In Hampshire County, a former arrestee may pursue either time-based expungement (governed by G.L. c.276, § 100E-100U) or non-time-based expungement. Applicants, however, must satisfy all eligibility requirements for any type of expungement. Some of these requirements include:

Time-Based Expungement

Non-Time-Based Expungement

  • The offense did not involve a weapon, an elderly or disabled person, or bodily injury or death.
  • The offense did not involve a firearm violation or illegal sale of a firearm.
  • The applicant does not have more than two offenses.
  • The applicant has observed the 7-year waiting period for a felony and the 3-year waiting period for a misdemeanor
  • The arrest resulted from an error or mistaken identity.
  • Another person falsely used the arrestee's identity.

Individuals who satisfy the requirements for either type of expungement will need to file a completed petition form and any relevant documents with the Clerk of the Court where the case was handled and the District Attorney's Office. Following an expungement, a petitioner can lawfully state that they have never been arrested.

Note: The expungement procedure in Hampshire County is distinct from the practice of sealing a record. Whereas sealing restricts public dissemination, the underlying data remains accessible to judicial bodies, law enforcement agencies, and authorized entities possessing a formal court order. The Massachusetts Court System's Request to Seal Your Criminal Record page has detailed information on the sealing process.

How Do You Remove Hampshire County Arrest Records From the Internet?

However, for arrest information on third-party websites, the subject of the expunged/sealed record may contact the website directly, provide a copy of the expungement order, and request that the website remove or withdraw the record from public access.
